What Information Does NatuHerbs Collect? 

The information that our Website collects from you depends upon your interactions with us as set forth more fully below. 

• If you choose to select products to put in your shopping cart on our Website, we will collect and store information on the products that you have chosen and the quantity of each item (collectively, “Shopping Cart Information”).
• In the event that you choose to checkout or finalize your transaction through our Website’s store, we will collect information about whether you want to utilize the express checkout functionality through ShopPay, PayPal, Google Pay, Facebook Pay or any other express payment that we may make available from time to time (“Express Checkout Information”). Use of these third party services is entirely voluntary.  Please note that the data collection practices of ShopPay, PayPal, and Facebook Pay are governed by the terms of service or use of each respective ecommerce merchant. 
• As an alternative to our express checkout functionality, we will request your email address or mobile phone number, your first name (optional), last name, address, apartment or suite number (optional), city, country/region, state, and zip code, desired shipping method, payment card number, the name listed on the payment card, the payment card’s expiration date, shipping code, and the shipping address, if it is different from the billing address (collectively, “Transaction Information”).
• When we collect your contact information in connection with completing a sales transaction, you have the option to receive news and offers from us via email (collectively, “Mailing Information”). You have the option to unsubscribe from this mailing list at any time by following the instructions included at the bottom of each such message.
• Our Website also includes the capability to provide testimonials for products purchased on or through the Website. If you choose to provide a testimonial, we will collect your overall rating based out of five starts, a title for your review, your review message, your name, your email address, and whether the review is based on your own experience and is your genuine opinion (collectively, “Testimonial Information”). 
• If you contact us by email or through our Facebook, Twitter, LinkedIn, or YouTube accounts, we will collect your name, email address, and the content of any message that you provide to us (collectively, “General Contact Information”).
• We also collect information from Internet Cookies as detailed more fully in the next section.

We use Usage Information to identify, troubleshoot, and rectify any technical issues with our Website, to combat fraud and other criminal activities that may be perpetrated on our Website by third parties, and to understand where visitors to our Website originate and the most commonly used internet browsers and computing devices, which helps us to optimize the Website for your browsing enjoyment.

How does NatuHerbs Use the Information it Collects on the Website?

The manner in which we use the information that we collect on or through the Website also depends upon the way in which you use and browse the Website as detailed below. 

• We use your Shopping Cart Information to maintain an accurate listing of the items that you have chosen to add to your shopping cart as your browse our ecommerce store. If you choose to checkout and finalize your purchase on our Website, we will use your Shopping Cart Information for purposes of completing your transaction. 
• If you choose to utilize our express checkout functionality, we will use the Express Checkout Information for purposes of redirecting you to the merchant that you have selected to finish your transaction with our Website. When your transaction is finalized through one of the express merchants, a token is provided back to confirm the transaction.  We use the Express Checkout Information to process and send you the products from your order. 
• Our third party ecommerce site provider uses your Transaction Information for purposes of processing your payment. We use your Transaction Information for purposes of fulfilling your transaction by preparing and packaging your products for shipment.  We will also use Transaction Information to administer customer support.
• To the extent that you opt-in to receive news and offers from us, we use your Mailing Information to send you these email communications.
• We will use your Testimonial Information, to the extent you submit a testimonial, for purposes of posting your testimonial to our Website for other users to see in connection with their own browsing of the Website and products.
• We use your General Contact Information for purposes of responding to any inquiry that you have made to us.
• We use the information that we collect from internet cookies as described in the section of this Policy entitled “Internet Cookies.”

Does NatuHerbs Disclose or Share Information that it Collects on the Website to Third Parties?

Legal Requirements

From time to time, NatuHerbs may be required by applicable law to disclose information that we have collected about you, such as in response to a court order, subpoena, or other lawful request from an administrative, judicial, or governmental authority.  We reserve the right, in our sole discretion, to lawfully challenge any legal requirement to prevent against such disclosure.  We will also disclose the information that we have collected about you, if we determine that such a disclosure is required in order for NatuHerbs to protect or defend its rights, property, or the safety of NatuHerbs, its customers, or a third party. 

Business Reorganization, Sale, or Insolvency

In the event that NatuHerbs chooses to reorganize its business, merges with another company, or decides to sell all or substantially all of its assets to a third party, the information that we have collected from you, including your personal information, will be among the assets transferred in connection with such a transaction to the acquiring business or the merging entity. 

In the unlikely event that NatuHerbs seeks protection or is otherwise involuntarily placed into bankruptcy, NatuHerbs assets could be subject to a sale to a third party.  Under such a circumstance, the information that we have collected from you, including your personal information, could be sold to a third party, unless: (1) the sale of such personal information is prohibited by applicable law, or (2) you have exercised any data rights afforded to you under applicable law that would prohibit us from selling such information about you.

NatuHerbs reserves the right to update this Policy in its sole discretion.  Each time we make a revision to this Policy, we will update the Last Modified Date that is listed at the top of this Policy.  Any updates to this Policy will become effective as of the date of posting, unless otherwise required by applicable law.  Please note that it is your responsibility to regularly check this Website for revisions to this Policy.  If you do not agree with any term or condition of the Policy, including any revisions, then you must immediately cease your use of the Website.  Your use of the Website after the Last Modified Date that is listed above shall be deemed as your acceptance thereof.

Options Regarding the Information Collected by NatuHerbs on the Website

Our Website does not currently honor “Do Not Track” signals or requests that are transmitted by or from internet web browsers.

Children’s Online Privacy

NatuHerbs does not knowingly market to or otherwise solicit personal information from children under the age of thirteen.  You must be at least eighteen years of age to use the Website.  If you are under the age of eighteen, please do not provide us with any personal information.  If you are the parent or legal guardian of a child that is under the age of eighteen and you believe that your child may have provided us with personal information, please contact us using one of the methods provided under the “Contact Us” heading so that we may immediately delete your child’s information.

Purposes of Processing

The personal data that we collect from you is processed for the purposes in this Policy.  The legal basis for the processing of personal data collected is set forth below:

• If you add items to your shopping cart, we process Shopping Cart Information based upon your consent and by contract as Shopping Cart Information is necessary for us to process in connection with any sales transaction that you enter into with us.
• If you choose to utilize our express checkout functionality, then we process your Express Checkout Information with your consent for purposes of passing you on to the appropriate express checkout merchant that you have chosen.
• We process your Transaction Information with your consent and by contract in connection with processing your sales transaction and providing you with the products that you have selected.
• We process your Mailing Information, to the extent that you opt-in to receive our promotional emails, with your consent, which you may withdraw at any time by following the instructions to unsubscribe as detailed at the bottom of each such message.
• We process your Testimonial Information with your affirmative consent by filling out the web form on our website and clicking to submit your testimonial.
• We process General Contact Information based on your consent in contacting us with an inquiry.
• We process information from internet cookies with your consent. If you wish to purchase products through our Website, deployment of necessary cookies are required in order for us to process your sales transaction.

We maintain your personal data for as long as you maintain an account with use and thereafter for only as long as is required for NatuHerb to comply with its legal obligations.

None of the data that we request through the Website is required by statute.  Our Website’s Terms of Use does require that all information that you submit be truthful and accurate.  Certain information that is required in order to complete a web form or transaction will be marked as “required.”  If you do not provide us with the required information, then you will be unable to submit the given form.  Any information that is designated as “optional” is not required and you do not have to provide us with any such information. 

EU Data Rights

In accordance with the GDPR, EU data subjects are afforded certain data rights, including:

• The right to request access to the data subject’s personal data;
• The right to request rectification of or the correction of inaccurate personal data that NatuHerb maintains about the data subject;
